Terms and Conditions relating to the purchase of MAIKAI PETS Products

These terms and conditions (the “Terms and Conditions”) apply to all contractual relations established between MILI REGDAN INTERNATIONAL SL, on the one hand, and the consumer entities (the “Consumer”), on the other hand, regardless of their legal nature (i.e. natural person, legal person, group of persons) and regardless of their geographical location, and this in respect of MAIKAI PETS products. Any reference to products (or product) is a reference to the pet products and accessories listed on the Website.

By placing an order on maikaipets.com, you acknowledge that you have read, understood and accepted these Terms and Conditions of Sale.

These Terms and Conditions of Sale constitute the contractual framework and therefore form part of the contractual relationship between MAIKAI PETS and its consumer (“the Contractual Relationship”). Without prejudice to the terms and conditions and other stipulations appearing on the Website relating to the mere use of the Website, the contractual relationship will generally commence at the moment when MAIKAI PETS has accepted the dispatch of an order for products placed by a consumer.

After placing an order through the Website, you will receive an order confirmation by e-mail. This confirmation does not constitute an acceptance of the order, but is merely informative for you and only serves as confirmation of receipt of the order by MAIKAI PETS.

MAIKAI PETS shall have the right to suspend any user account of any consumer on the Website and to prevent deliveries if the company knows, or has reasonable grounds to believe, that there is infringement or unfair treatment by any consumer in the use of the Website.

MAIKAI PETS reserves the right to refuse orders at its own discretion. The company shall be entitled, if it considers it necessary or desirable, to engage third parties for the proper performance of any contractual relationship with agreement and to pass on the costs of such engagement to the consumer.

MAIKAI PETS reserves the right to adjust its terms and conditions. If any provision of these terms and conditions is unenforceable or contrary to a mandatory provision of law, the validity and enforceability of other provisions of these terms and conditions shall not be affected. In such a situation, the unenforceable or contrary provision will be replaced by an enforceable and legally valid one that is as close as possible to the economic objective of the original provision.

When you access our website the first thing you will see is a top menu where we give you important information:

  • Information about the shipping price, that at this moment the orders with an amount higher than 39€ are free (In peninsular Spain). Keep in mind that this is something that we can change or delete, so what is shown on our website will always prevail.

However, the inclusion of all taxes to be applied may not be complied with in the event that the order is placed from outside Spain, in which case, tax elements derived from the country of reception in question may be added in the payment process.

MAIKAI PETS reserves the right to change prices without prior notice. However, upon receipt of the order confirmation, the prices payable for the order will not be affected.

MODIFICATIONS AND INVALIDITY

CLAIMS AND ACTIONS ARISING FROM THE CONTRACT

This agreement is governed by Spanish law.

In order to simplify the resolution of civil claims and reduce costs, we do not exclude the possibility of submitting to an Arbitration of Equity of the Court of Arbitration of the Chamber of Commerce, Industry and Services of Madrid. However, MAIKAI PETS reserves the right to resort or not to Arbitration Courts depending on the specific circumstances of the case.

In any case and without prejudice to the foregoing, the following is established for the resolution of conflicts arising from or related to these transactions:

a) Consumers and Users: the Courts and Tribunals of the consumer’s domicile and/or the place where the obligation is fulfilled shall have jurisdiction.

b) Businessmen and Professionals: the Courts and Tribunals of the city of Madrid shall have jurisdiction.

PRICES AND TAXES

The products will be sold at the price indicated on the Website, being in force the price stated at the time of the confirmation of the order you place.

All prices include the Value Added Tax (VAT) in force, but exclude shipping costs, which will vary depending on the value of the products purchased, and the country or region to which delivery is to be made.

Prices shall remain fixed and shall not change during the period of validity set out in the acceptance of the order. Prices are subject to fluctuations resulting from circumstances beyond the control of MAIKAI PETS (e.g. fluctuations in the VAT rate, specific tax adjustments, etc.).

PURCHASING PROCESS

Every order placed with MAIKAI PETS through our Website will be covered by these Terms and Conditions of Sale. By placing your order, you acknowledge that you have read, understood and accepted these Terms and Conditions of Sale.

As a consumer you declare that you have explicitly taken note of the terms and conditions below and that you accept their content in full and without reservation.

HOW TO SHOP ON THE WEBSITE?

It’s very simple! First of all you will have to choose the product or products you want, and to do so you will have to go to the top of the web where you will find the menu with different sections and choose the one you are most interested in (or what your furry one likes the most).

1.- Choose your products

As we want to make it as easy as possible for you to select your product, follow the steps below:

1. By clicking on each product you can choose the desired quantity and add the products to the cart, you can also read all the information, all the ingredients they contain and the comments of other customers. They are sure to be of great help to you!

2. Choose the quantity of each product you wish to purchase.

3. Click on the “Add to cart” button. Repeat this process as many times as necessary until you have chosen and added to the cart all the products you wish to purchase. In the same way, if after choosing a product you finally do not want to buy it, simply click on the cart icon and then on “delete” the product.

4. Once you have added the products to the cart, you can continue shopping, adding more products or even change the quantities of some products. Once you have your favorite products in the cart you can click on “VIEW CART” and then click on “PROCESS ORDER”.

Remember! If you have a coupon you can apply it in the blank space provided and click “APPLY” and then click “CONTINUE” to proceed. Remember that in the case of promotions, vouchers are not usually cumulative, nor can they be combined with other vouchers.

2.- Give us your personal information so that we can issue the invoice and send you your products.

Once you have finished choosing your products click on the cart icon and then on the “Checkout” button. A new screen will appear where you will have to give us your contact information and the necessary data so that we can issue your invoice if you request it:

Contact details: we need you to provide us with a valid email address and a postal address to send your order to. If after completing the purchase process you want to change the delivery address of the order:

  1. Go to your account.
  2. Check if the order has been processed or not. If not, modify it there.
  3. If it has already been processed, please send us an email to [email protected] and notify us of your request by adding “Order number” and “I want to change the delivery address of my order” in the subject line.

If the package has not yet left our warehouse, we can modify it without any problem. If, on the other hand, your order has already left our facilities, we will have to talk to our shipping agency (GLS), so that they can modify it and redirect your order to the new address. Please note that this may delay your order by a couple of days.

Billing and payment data:

  • Means of payment: We currently accept credit cards (Visa, Maestro, Mastercard…) as means of payment. Our transactions are secure and encrypted.
  • Billing address: You have to tell us if the address we have to reflect in the invoice is the same as the one where we send the product or a different one. By default, you will be shown “The same shipping address” as preselected, but if you want to use a different one you have to click on “Use a different delivery address”; a form will be displayed and you will have to fill it in. Make sure you have filled in all the fields correctly.

3. Shipping costs, discount and final price

Shipping costs:

  • Spain (Peninsula and Balearic Islands): Currently if your order is over 39 € you will have free standard shipping costs. If the amount is less than or equal to 39 € the standard shipping costs (1 to 3 days) will be 2,99 €. This period may be longer during sales periods, Black Friday, Christmas or specific promotions.
  • Europe: For shipments that are not made within the Iberian Peninsula, the shipping price will be calculated at the time of checkout, depending on the shipping destination.
  • Discount: If you have a discount to be applied you have to enter it in the corresponding box at the checkout, after adding your products to the cart. You will be able to identify it easily because you will be able to read “Discount code” in the field to be filled in. After entering it, click on the “Use” button and it will be applied automatically modifying the amount of your order.
  • Final price: The final price of your order will be the result of adding the amount of each product, plus applicable taxes and fees. However, this final price will be modified according to 2 circumstances: if you have to pay or not the shipping costs and if you have any discount.

Important: The prices of all our products are in euros (€) and include applicable taxes (VAT).

4. Product delivery

At the moment you make the purchase you will receive a confirmation e-mail and we will get to work so that you receive your order as soon as possible. As soon as it leaves our warehouse, GLS will send you an e-mail informing you of the time slot in which it will deliver your package the next day, so you will be informed at all times of its status. The average delivery time is 1 to 2 working days if the place of shipment is within the Peninsula*. This period may be longer during sales periods, Black Friday, Christmas or specific promotions.

USE OF PROMOTIONAL CODES
  • Only one promotional code may be used per order, i.e. two promotional codes may not be used in the same purchase.
  • Each promotional code can only be used once per user.
  • The validity of promotional codes is limited exclusively to their use on the official MAIKAI PETS website, unless otherwise indicated in the communication in which they are announced.
  • Promotional codes will be valid until the date indicated in the communication in which they are announced (emails, social networks, customer service channels, etc.). In case of no explicit date, MAIKAI PETS reserves the right to cancel any code without prior notice.
  • Codes associated with influencers/ambassadors will remain in effect until the relationship with them ends or until they publish a new code; in which case, the new code will become active immediately, replacing the old one.
  • The general conditions of purchase, exchanges and returns will apply to any order in which a promotional code has been used.
  • Codes are not redeemable for cash.
  • Each code will be assigned specific conditions that will apply exclusively to that code and must be duly explained in the communications in which they are announced.

INFORMATION ON PAYMENT METHODS

Payment is made in the last step of the purchase process.

Payment options

Payment for your order can only be made by credit or debit card (Visa or Mastercard) through our payment gateway Stripe.

Payments by check, wire transfer, cash on delivery, bizum or cash will not be accepted.

Payment by credit/debit card

In the case of payment by credit/debit card, the amounts will be charged from the time of purchase of the goods.

In the event that the details of the purchaser and the cardholder do not correspond, MAIKAI PETS reserves the right to contact the customer to confirm their identity or to contact the bank to ensure that there are no reports of theft of the bank card.

In the event that the payment could not be made for any reason, MAIKAI PETS will contact the customer by telephone or via the e-mail address provided at registration to inform him/her of the incident.

Stripe

Stripe is an online payment service, which guarantees a secure, easy and fast payment. While ordering you have the possibility to open an account or pay directly through the platform without registration.

If for any reason you are unable to complete your order or if there is an error, please write to [email protected] estamos always on the other side to help you.

When you have completed the corresponding steps in any of the payment options, you will be directed back to the MAIKAI PETS Website, where you will see an order completed message. In addition to receiving the order confirmation e-mail.

Privacy and Security/Payment Methods

Stripe is the most reliable, secure and fast way to make online payments. As they are the ones who make the payments directly to our customers, MAIKAI PETS will not have access to the bank details of the latter.

We have contracted the SSL Certificate, which protects consumer privacy.

We reserve the right to use commercial data in an anonymous form to study purchasing habits and usage.

SECURITY MEASURES

We take all necessary technical and organizational measures to protect the security and integrity of personal and non-personal information collected. Both against unauthorized access and against accidental alteration, loss or destruction. The sending and forwarding of data that you make through the Service is protected by electronic network security techniques such as the SSL protocol. Likewise, the information provided and stored in our databases is also protected by security systems that prevent access to them by unauthorized third parties. We make our best efforts to have the most up-to-date systems for the effectiveness of these security mechanisms. In addition, we store personal and non-personal information for as long as permitted and required by law. That which is not needed is periodically destroyed. Notwithstanding the foregoing, we cannot guarantee the absolute security of the information collected, so you should cooperate and use common sense at all times about the information shared.

As mentioned above, the entire sales process, as well as the transmission of your personal and credit card data, is carried out on a secure page and encrypted through the SSL protocol.

POLICY FOR RETURNS, EXCHANGES, CANCELLATIONS AND ORDER MODIFICATIONS. RIGHT OF WITHDRAWAL

1.- Have you changed your mind about your order? It’s OK, the return is very easy!

If you have changed your mind about your order, don’t worry if you haven’t opened the products for your furry friend!

The products to be returned must be in the same condition in which they were received; unopened and with the original packaging and box and within a maximum period of 14 calendar days from the day of receipt without the need to allege any cause, through an unequivocal statement.

If the products concerned are foodstuffs, only unopened and intact packages may be returned. You cannot make use of your right of withdrawal on perishable products after the expiry date.

Remember! If it is a pack, it cannot be divided, so it is necessary to return the whole pack.

MAIKAI PETS does not accept returns or exchanges whose written notification is made after 14 calendar days from the date on which you receive the products or a third party that you indicated when you placed the order, other than the carrier. We will not refund if the product has been opened, used or damaged, so you should be careful with the product(s) while they are in your possession.

We will not reimburse in the following cases:

– Damaged products due to incorrect use or negligence.
– Products not purchased on the Website.
– Open products.

Any return or exchange must be authorised by MAIKAI PETS.

MAIKAI PETS cannot be held responsible for delays or failures in deliveries caused by circumstances beyond its reasonable control. Such circumstances include strikes, war, natural disasters or any other situation that may prevent the production, transportation or delivery of products.

How to make a return?

In order for us to manage and authorize the return, you must fill out the form that appears under the “Shipping and Returns” page that you will find in the footer of the website. It will only appear if you are logged in with your username and password. Complete all the information with the order details and we will tell you how to do it.

Once you have received the return or exchange authorisation, you can proceed to return the products to the address indicated in the confirmation email.

The refund will be made using the same payment method you used to pay for your order, once MAIKAI PETS has received the products and we have checked that they are in perfect condition. You will be responsible for the return or exchange transport costs.

If the above conditions are met, you will be entitled to a refund of the amount you paid for the products. Only if MAIKAI PETS has made a mistake in the order will the shipping costs of the original order be refunded. In no other case will MAIKAI PETS refund the shipping costs of the original order. The refund will be made as soon as we have recovered all the products or if you can prove that you have returned the products (e.g. a tracking link).

This provision does not affect consumer rights under existing legislation.

2.- Product warranty in case of defect or not matching the purchase reference number

If this happens, we will take care of the whole process very easily and at no cost to you. Send an email to [email protected] with the order details and a photograph of what you have received, so that we can sort it out quickly.

Once we receive the returned products, we will check them with a quality control.

If the quality control confirms the non-conformity or defects of the returned product, we will contact you to confirm that the refund has been processed. In these cases, within a maximum period of 14 calendar days, we will reimburse you for all the costs incurred, including: the amount you paid for the product(s) being returned and, where applicable, the initial shipping costs and the shipping costs generated by the return. The refund will be made by the same payment method you chose at the time of placing the order.

If no non-conformity or material manufacturing defect is detected after quality control, we will refund the price of the product, minus the initial shipping costs. In this case, the customer shall bear the shipping costs that may arise from the return.

3.- Modification/Cancellation of an order:

If you want to modify/cancel your order, please follow these steps:

  2. 2.Detail in the subject “Modification/cancellation” + the order number.
  3. 3.Detail clearly what you want to do.
  4. 4.In case of a modification, explain clearly which products you want to change.

Both cancellations and modifications may be made if the orders have not left the warehouse; otherwise, you will be entitled to operate in accordance with the provisions for returns.

In all these situations we will try to solve your problem as quickly as possible. In any case, you are guaranteed all the rights that the laws in force guarantee you as a consumer and user.

Conformity, warranty and indemnity

MAIKAI PETS will endeavour to deliver you the best products, as stated in your order, which correspond to a reasonable usability/validity and all legal provisions.

Except in the case of gross misconduct or intent, or negligence on the part of MAIKAI PETS, any liability of MAIKAI PETS for any breach of contract is excluded. In no event shall MAIKAI PETS be held liable for indirect losses (such as loss of income, opportunities, …). The overall liability of MAIKAI PETS is financially limited to the total amount mentioned on the invoices relating to the products in question. MAIKAI PETS does not guarantee the quality of products that have been damaged deliberately or through negligence on the part of the consumer, or that have not been used according to its instructions.

The consumer shall be obliged to indemnify MAIKAI PETS against claims from third parties (including governments) and shall be liable for the costs arising from his negligence.

PRIVACY POLICY

INFORMATION ON PERSONAL DATA PROCESSING

By creating a user account, data of our consumers will be collected in the MAIKAI PETS database. The personal data received will only be used for internal customer management, such as for the execution of an order or communication of products.
